TLU SA President, Henry Geldenhuys, will today submit a criminal complaint against Andile Mngxitama, a member of the MK Party and Member of Parliament, at the SAPS Community Service Centre in Sheepmoor. The criminal complaint was drafted and signed on 6 November 2026. It follows Mngxitama’s remarks in which he expressed support for the farm attack on Donovan Marx, during which the victim’s ears were cut off.
Mngxitama allegedly stated that the cutting off of farmers’ ears was symbolic of white people’s refusal to listen. He also referred to farmers as land thieves and said that he celebrated the attack on Marx and would not apologise for his remarks.
TLU SA regards these statements as extremely serious and unacceptable, particularly against the backdrop of the ongoing violent crime affecting South African farmers.
“TLU SA is an agricultural organisation representing commercial farmers who are already suffering under persistent violent crime. Openly celebrating a brutal attack on a farmer and making statements that justify violence against a particular group of people is unacceptable. No person, regardless of their political position, should be allowed to incite racial hatred or encourage violence and murder in South Africa,” says Geldenhuys.
The criminal complaint is based on sections 9 and 16 of the Constitution of South Africa, which respectively protect the rights to equality and freedom of expression.
TLU SA previously submitted a separate complaint to the South African Human Rights Commission (SAHRC) regarding Mngxitama’s remarks on 5 November 2026.
Geldenhuys calls on the SAPS to investigate the criminal complaint thoroughly, consider the relevant constitutional provisions and other applicable legislation, and take the necessary steps to hold Mngxitama accountable for his statements.
“Freedom of expression cannot be used as an excuse to glorify violence, incite racial hatred or mock the suffering of victims of farm attacks. We cannot remain silent when such statements are made. The safety and dignity of every South African must be protected.”
TLU SA will monitor the progress of both processes and continue to take action against any conduct or statements that encourage violence against farmers and rural communities.
