TLU SA Limpopo notes the judgment handed down by the Howick Magistrate’s Court in which four individuals were convicted of illegal hunting activities in terms of section 42(2) of the KwaZulu-Natal Nature Conservation Ordinance.
We welcome the Court’s confirmation that the law does not have to wait until wildlife has been killed before action may be taken. The protection of wildlife begins with the prevention of crime, not merely with the prosecution of offenders after the damage has already been done.
For farmers, however, this judgment is significant for another reason. Illegal hunting is seldom an isolated offence. It is often accompanied by unlawful trespassing on private property, violations of property rights, threats to farming families, damage to infrastructure, and the loss of valuable game and livestock. This places a substantial financial and security burden on landowners.
The judgment sends an important message that the justice system is prepared to act where sufficient evidence of illegal hunting activities exists, even before irreversible damage occurs.
TLU SA Limpopo also calls on law enforcement authorities to afford the same level of priority to all crimes affecting farmers and rural communities. Preventative action, prompt investigations, and effective prosecution are essential to strengthening confidence in the criminal justice system.
